You only get texts you agreed to. Reply STOP to any message to stop, and HELP for help. Message frequency varies and message and data rates may apply. Businesses using Ottonomous must collect your consent before texting you, and your number and consent are never shared for marketing.

1. Overview

These Messaging Terms apply to text messages (SMS and MMS) and phone calls sent or placed through the Ottonomous platform, operated by Ottonomous Technologies Inc ("Ottonomous", "we", "us"). Messaging is delivered through our telecommunications provider, Twilio. There are two kinds of messaging programs:

  1. Ottonomous account messages. Messages we send to people who use the Ottonomous platform, such as verification codes, security alerts, and account notifications.
  2. Business messages sent through Ottonomous. Messages a business that uses our platform (a "Business") sends to its own customers, such as replies to an inquiry, appointment reminders, service updates, and, where the customer agreed to them, offers and promotions. The Business is the sender of these messages and is responsible for its content and for the consent it collected. Ottonomous provides the technology.

By providing your mobile number and agreeing to receive messages, you agree to these terms, to our Privacy Policy, and to the terms of the Business you agreed to hear from.

You will only receive messages you have agreed to receive. Consent is collected in one of these ways:

  • Online form. You enter your mobile number and check an unchecked consent box on a website form (for example, a vehicle inquiry, service appointment, or newsletter form) that displays the disclosure shown below.
  • Keyword. You text a keyword (for example, a Business's advertised keyword) to a Business's number.
  • In person or by phone. You give a Business your number and ask to be texted, and the Business records that consent.
  • Reply. You text a Business first, which allows the Business to reply to you about that conversation.

Consent is not a condition of purchasing any goods or services. Consent given to one Business applies only to that Business and its phone number. Consent for Ottonomous account messages is collected when you add a phone number to your platform account and applies only to account-related messages.

Each Business is required to keep a record of when and how you consented and to show you the following disclosure before collecting your number:

3. What messages you may receive

From Ottonomous (account messages). One-time verification codes, sign-in and security alerts, and notifications about your account or activity in the platform that you enabled. These are transactional. We do not send marketing text messages to platform users without separate consent.

From a Business using Ottonomous. Conversational replies to your questions, appointment confirmations and reminders, vehicle availability, service status, delivery and pickup notices, review requests, and, only if you agreed to them, offers, promotions, and event invitations. Some replies may be drafted or sent with the help of AI under the Business's supervision.

Message frequency varies depending on your activity and the messages you agreed to receive. Message and data rates may apply according to your mobile carrier plan.

4. How to opt out

Reply STOP to any message to stop receiving messages from that sender. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT. You will receive one final message confirming that you have been unsubscribed, and the sender will not text you again unless you opt in again.

Because consent is per Business, replying STOP to one Business does not opt you out of messages from a different Business or from Ottonomous account messages. Reply STOP to each sender separately, or contact us and we will help.

For Ottonomous account messages, you can also remove your phone number in your platform profile. Note that two-factor authentication requires a phone number or an authenticator app.

5. How to get help

Reply HELP to any message to receive a message with contact information for the sender. You can also contact Ottonomous at [email protected] or by phone at the number on our Contact page. For messages from a Business, you may also contact that Business directly.

6. Carriers and delivery

Messages are delivered through major United States carriers, including AT&T, T-Mobile, Verizon, US Cellular, and their networks and affiliates. Carriers are not liable for delayed or undelivered messages. Delivery depends on factors outside our control, including carrier filtering and your device and coverage. Do not rely on text messages for urgent or emergency communication.

Messages may be sent from local 10-digit numbers or toll-free numbers registered to the Business or to Ottonomous. Where required, Businesses register their brand and messaging use case with carriers before sending.

7. Phone calls and recordings

Businesses may place and receive phone calls through platform numbers, and may enable call recording or transcription to help their team follow up. Where recording is enabled, the Business is responsible for playing any notice required by the laws that apply to the call, and you may ask the Business to stop recording. Some inbound calls may be answered by an automated assistant; you can ask to speak with a person at any time.

8. Privacy of your mobile information

Your mobile number and your consent records are used only to send the messages you agreed to receive, to honor your opt-out, and to keep the records carriers and law require.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Requirements for businesses using Ottonomous

If you are a Business sending messages through the platform, you agree that you will:

  • collect and document prior express consent before messaging anyone, and prior express written consent before sending marketing messages, as the Telephone Consumer Protection Act and CTIA guidelines require;
  • display the consent disclosure in Section 2, or language substantially like it, wherever you collect mobile numbers, and keep the consent box unchecked by default;
  • never upload or message purchased, rented, or scraped contact lists;
  • honor STOP and other opt-out requests immediately (the platform enforces this automatically for platform numbers) and never re-add an opted-out contact without new consent;
  • identify your business in messages, send during reasonable hours (between 8 a.m. and 9 p.m. in the recipient's time zone unless they started the conversation), and keep frequency consistent with what people agreed to;
  • follow our Acceptable Use Policy, including the prohibition on content carriers do not allow;
  • provide any call-recording notice required in your state and the recipient's state; and
  • complete carrier registration (A2P 10DLC or toll-free verification) through the platform before sending at volume.

We may suspend messaging for any Business that violates these requirements or generates carrier complaints.

10. Changes

We may update these terms. Changes will be posted here with a new date. Material changes to how consent is collected or how you can opt out will be communicated in a message before they apply.
